China Releases Administrative Measures for Labor Dispatching Licenses

The amendment to Employment Contract Lawwas formally implemented on July 1st 2013. On the same day,the Ministry of Human Resources and Social Security of China (MOHRSS) released the Administrative Measures for Labor Dispatching Licenses. Required by the Measure, staffing agencies wishing to engage in labor dispatch business must now obtain a special license from local labor administrative bureau with a registered capital of not less than RMB 2million. At present, the local administrative bureaus in different provinces of China have begun to process the application for labor dispatch licenses.

In order to clearly specify the percentage limit of labor dispatched workers in a user company and other crucial items, on August 7, 2013, MOHRSS draw up a draft of “Rules on labor dispatch”and made it open the public to solicit the opinions of the society from August 7 to September 7, 2013. The rules will have a clearly specification and definition on some crucial items, which are also the big concerns of staffing agencies, such as the percentage of labor dispatched workers accounting for the whole staff in a user company, what is the exact meaning of “auxiliary position”, and administrative measures on trans-regional labor dispatch business, etc. According to the draft, the percentage of labor dispatched works at the “auxiliary position” in a user company should be less than 10%. Staffing agencies who undertake the trans-regional labor dispatch business must set up a branch company at the place where the dispatched workers are to be placed. Currently, the government department is making research on the opinions of the society and trying to release the rules as soon as possible.
